Overview

The legal challenges presented by the use of artificial intelligence (AI) in the delivery of healthcare are examined in a new report issued today by international law firm DAC Beachcroft (DACB).

‘AI in healthcare – transforming the UK’s health system’ brings together leading clinicians, regulators, developers, investors and lawyers to discuss the potential that AI technology offers through the key themes of innovation, investment, data handling, regulation and liability.

AI-assisted healthcare is a rapidly developing and fast changing area – the NHS alone already uses more than 130 AI-based products to diagnose or treat 70 conditions – as well as being a significant growth area for investment and innovation.

But key to its success is patient buy-in, with many people seeking reassurance about AI-based technology’s ability to protects their rights and manage their confidential data, and ensure compassion and humanity are not driven out of their medical care.

Insight and analysis for ‘AI in healthcare’ is provided by leading industry experts Dr Junaid Bajwa, Chief Medical Scientist at Microsoft Research; Sarah-Jane Green, Head of AI Regulations and Policy at NHSX; Johan Ordish, Head of Software and AI at MHRA; Dr Nicola Byrne, National Data Guardian for health and adult social care in England; Dr Peter Feldschreiber Barrister at 4 New Square chambers; and Seb Wallace, Investment Director at Triple Point.

Compilation of the 20-page report has been led by members of DACB’s market-leading health team, including partners Hamza Drabu and Darryn Hale, legal director Jonathan Bonser and Alison McAdams, Head of Life Sciences.

Darryn Hale comments, “There is no doubt that AI technology is going to play an increasing role in the future of the delivery of healthcare, but key to its adoption will be clarity on its regulation alongside trust from both clinicians and patients in the products.

“We are very pleased to have brought together key voices who will have a part in shaping the future of AI in healthcare for this report, with our contributors’ thoughts and insights combining to provide a holistic overview of the key issues and the potential of deploying AI in the delivery of healthcare.”

‘AI in healthcare’ was unveiled in Soho, London this week at a launch event attended by contributors to the report and selected senior healthcare industry stakeholders.

Guests also heard from keynote speaker Dr Kira Radinsky, a specialist in the field of AI, who co-founded Diagnostic Robotics to build an AI-powered diagnostic and prediction system designed for healthcare, based on billions of medical records and historical patient visits.

Nigel Montgomery, Head of Health at DACB, adds, “The issues surrounding healthcare and AI are complex and interrelated. As a rapidly developing area, it requires experts in law, medicine, technology, business and ethics to work together to understand how the various elements interlink to ensure a successful outcome.”
