Gillian is highly regarded and well liked among clients, having practiced exclusively in the professional negligence field her full qualified career of over 12 years.
Gillian has extensive experience of handling professional negligence claims against solicitors on behalf of the lead insurers under the Law Society of Scotland Master Policy. She also has experience of handling the defence of claims against a wide range of other professionals including, but not limited to, accountants, estate managers, educational institutions, surveyors, engineers and other construction professionals. She has dealt with D&O/management liability claims, including the defence of a high-profile D&O claim brought by the liquidators of an insolvent company against its former directors.
A strong team player, as well as dealing with her own varied caseload, Gillian not only mentors more junior colleagues but also ably assists Partners in the team with high value, multi-party, complex claims when required.
Gillian is thorough and highly organised and particularly adept in the use of technology to assist in the efficient handling of large complex and high value cases.
She has extensive experience of both Sheriff Court and Court of Session procedure, particularly in respect of cases running under Commercial Procedure. Gillian is also very experienced in the use of mediation, which she has used to good effect, where appropriate, to bring cases to early resolution.
Relevant experience includes:
- Defending numerous solicitors facing a significant raft of claims, brought by various lenders, seeking recovery of losses attributed to alleged multiple and systemic breaches of the provisions of the CML Handbook.
- Representing a Firm of Solicitors and their insurers in the defence of a highly complex seven figure claim for breach of contract, negligence and loss of opportunity in allegedly failing to advise their clients to seek legal advice from English lawyers in relation to potential personal injury claims involving novel issues of medical and legal causation.
- Acting for, and successfully defending, a tertiary education establishment in the defence, after proof (trial), of a significant and potentially reputationally damaging Sheriff Court action brought against them by a former student for alleged discrimination and procedural failures.
- Representing a hotel management company and their insurers in the defence of a counterclaim for breach of fiduciary duties, raised in response to the clients' own action for count reckoning and payment.
