Biography
David is a barrister in our specialist advocacy service, 8 DAC Beachcroft Buildings (8DB).
David specialises in civil litigation with a focus on personal injury litigation, motor claims (including credit hire), fraud, and costs.
He has 9 years of experience in these sectors, advising clients from both a Claimant and Defendant perspective. He has taken instructions from some of the country’s leading motor, home and public liability insurers including the AA, Aviva, LV, Markerstudy, NFU Mutual and RSA.
Having worked both in house and in external chambers, and for solicitors specialising in both Claimant and Defendant work, David’s experience enables him to give well-rounded, practical advice.
David’s practice covers the fast and multi-tracks, having been instructed in trials and JSMs valued at up to £500,000 and in interlocutory hearings worth up to £30million. He has extensive experience in all aspects of liability and quantum assessment, in particular in claims arising from road traffic accidents where he has conducted over 250 hearings in the last year alone, and over 1,000 in total
David has appeared before a variety of courts and tribunals including the Court of Appeal, High Court and County Court. He is regularly instructed in trials, applications, CMCs and CCMCs, and assessment, disposal and Stage 3 hearings. He drafts statements of case, Part 35 and Part 18 questions, and provides advices on liability and quantum. He is also available to provide training, and has delivered numerous seminars to lawyers and insurers.
Relevant experience / notable cases includes:
- Diriye v Bojaj [2020] EWCA Civ 1400 – David appeared at the Court of Appeal as sole counsel on behalf of the successful respondent in this seminal credit hire authority. The Court clarified the rules pertaining to service by recorded delivery, and confirmed that Claimants have to set out all facts upon which they intend to rely when averring impecuniosity.
- D v J and S (2020) – defended a chain of pubs in a 2-day split liability trial in respect of a Claimant who was employed as a bouncer and sustained injury when assaulted by customers.
- D v B (2020) – represented the Defendant at a Joint Settlement Meeting in respect of a Claimant who suffered multiple injuries including extensive orthopaedic injuries. The claim was valued in excess of £500,000 but settled at £170,000.
- Brownsell v Ogden (2019) (Lawtel: Doc No AM0505445) – David represented the Claimant in this complex personal injury claim. The Claimant was a pre-accident amputee who suffered additional injury to his prosthesis following a road traffic accident, impacting his ability to work as a stuntman. He was awarded £35,000.
- Re: John Schoenemann (2018) – David represented the Auto Cycle Union in a 2-day inquest following the death of a motorbike racer. The coroner recorded an accidental death conclusion.
