James specialises in defending both Credit Hire and fraudulent claims ranging from Small Claims to Multi Track. He provides training and advice to clients in relation to Credit Hire updates/case law and strategy.
He has over 12 years’ experience advising clients across a range of credit hire and damage issues ranging from loss of profit claims to diminution in vehicle value claims. His key clients include Aviva Insurance, Collingwood Insurance, Covea Insurance, a number of Gibraltar based insurers as well as a number of self-insured companies and brokers.
James also advises clients on their vehicle damage strategies and how to reduce their indemnity spend in this area, covering such damage areas as:
- Diminution in vehicle value.
- MOJ abuse of process claims.
- Recovery of litigation costs against credit hire companies.
Relevant experience includes:
- Successfully running the case of Zurich Insurance plc v Umerji [2014] EWCA Civ 357 in the Court of Appeal which extended the principle and meaning of impecuniosity.
- Advising clients on their protocols with credit hire companies and recently advising a large insurer on their exit from a multi-million pound protocol and subsequent litigation strategy.
- Regularly advising clients on market changes in credit hire and damage claims, using DAC Beachcroft’s Know Your Opponent tool to tackle specific issues targeting his clients and analysis of MI to support clients in evolving their strategies on a year by year basis.
