On coverage, we were materially involved in the evolution of the Law Commissions' reform on Insurance Contract Law, culminating in the Insurance Act 2015 and the Consumer Insurance (Disclosure and Representations) Act 2012. We are skilled in advising on a broad spectrum of coverage issues, from fair presentation of the risk to breaches of warranties and conditions, fraud and damages for late payment.
We have significant experience in handling our clients' full portfolio of liability claims, from attritional volume through to complex, high value and high profile matters. Recent examples include the Grenfell Tower fire incident and the London 2011 riots.
Our focus is always on giving advice that is commercial, cost effective and that aligns with our clients' approach to customer care. The team is experienced in finding innovative and commercial solutions for our clients.
Featured experience
- On the morning of the tragic fire we were instructed on behalf of Rydon Maintenance Ltd (RML) the Design and Build contractor retained by the local authority to undertake the refurbishment of Grenfell Tower. A Public Inquiry into the fire was announced the following day and RML was subsequently designated a core participant in the Inquiry. We continue to advise RML throughout the Inquiry as well as in respect of all parallel civil and regulatory proceedings.
- We represented London market insurers in successfully arguing that a recovery claim could be brought against a sub-contractor engaged on a remedial project on a south-east London school that burned down during the works, where a project policy taken out purported to extend to 'sub-contractors of any tier'.
