Biography
Ben is an Associate in the Global Property & Casualty team, specialising in complex coverage and insurance/reinsurance disputes. His practice comprises a mix of domestic and international matters arising from major, technical losses primarily involving liability policies (commercial / general, products, pollution/ELL) and construction / project insurance. In addition, he has experience of advising in relation to SRCC, political violence, financial crime and first-party energy losses. Ben also assists insurers and insureds on contractual and liability issues arising in energy, construction and engineering disputes. Ben has experience of mediation, High Court litigation (Commercial Court, TCC), adjudication and a number of arbitral forums, including the ICC and LCIA.
Ben’s recent and current experience includes:
- Providing contractual advice and defending third tier designers / suppliers in relation to offshore wind project disputes in the UK and Europe
- Defending excess insurers in an ad hoc English law coverage arbitration arising from an explosion at a hazardous waste processing facility in the USA
- Advising on coverage and liability in relation to construction / demolition site accidents and pollution incidents in the UK
- Defending a global facilities management company in a LCIA arbitration concerning a contractual indemnity claim brought in connection with damage caused to an aircraft by a third party
- Advising project insurers following the collapse of the construction of an underground system in Germany and subsequent coverage proceedings
- Representing reinsurers in relation to claims and coverage disputes concerning power failures, gas pipeline losses, oil spillages and pollution liabilities in Turkey, Costa Rica, Peru, Chile and Ecuador
- Acting for re/insurers or excess insurers in connection with complex casualty and product liability suits in the UK, USA, Israel, Mexico, Brazil, Puerto Rico and the Caribbean
Ben is qualified in England & Wales and joined DAC Beachcroft in 2020.
