About Casey

Bio
  • Biography

Casey specialises in insurance litigation for insurers, intermediaries and self-insured in Scotland.

She has over 10 years’ experience advising clients in a wide range of insurance claims including road traffic accidents, credit hire, fraud, property damage and workplace accidents in both the Sheriff Court and Court of Session. Her key clients include Admiral, Zurich and AXA.

Casey is involved in the day to day supervision and operational management of the motor injury team in Glasgow dealing with litigated and pre-litigated Protocol cases up to £150,000. She also handles her own caseload of predominantly higher value claims.

Casey has responsibility for compliance with insurer protocols, service level agreements and the provision of management information for insurers. She regularly delivers training to clients on Scottish civil procedure.

    Relevant experience includes:

    • Advising on complex issues of jurisdiction and applicable law in claims brought in Scotland by relatives of a person fatally injured in an accident in England.
    • Defence of a claim raised against motor insurers involving a pursuer who fell from the cab of a lorry sustaining injury. The accident occurred whilst the lorry was being loaded in a yard. It was successfully argued that the EL policy should respond as the accident involved the use of work equipment and the claim was re-directed to the EL insurer.
    • Securing a significantly reduced settlement in a fatal claim intimated by the surviving partner of the deceased. They had never married and investigations revealed a complex relationship. Consideration had to be given to the wording of the Damages (Scotland) Act 2011 which allows a claim to be made by the surviving partner only if he/she and the deceased were living together as if married immediately prior to the accident. A strict application of the law would have resulted in the partner's claim being struck out in its entirety.

Casey’s professional memberships include Notary Public and Law Society of Scotland Accredited Specialist for Personal Injury.
