    Gareth routinely advises both regulated and non-regulated businesses on anti-money laundering, bribery, and sanctions issues and he is experienced in handling complex internal investigations and regulatory and criminal self-reporting in these areas.

    In addition to his criminal and regulatory investigations and litigation experience, Gareth has a burgeoning commercial litigation practice, where his focus is on assisting both regulated and non-regulated clients to investigate instances of internal fraud, including push payment and business email compromise.

    Gareth is increasingly engaged to advise on strategy for both investigating such situations and seeking the recovery of funds, whether from fraudulent account operators or via the relevant financial institutions including utilising the Court's Norwich Pharmacal and Bankers Trust jurisdiction to provide victims of fraud with access to information held by relevant third parties via Orders to compel its production. Where such matters – and others Gareth is involved in – proceed to settlements, he has gained substantial experience in drafting and negotiating such agreements.

    Gareth's key criminal and investigations experience includes:
    • Being part of the team that acted in R (on the application of KBR, Inc) (Appellant) v Director of the Serious Fraud Office (Respondent) UKSC 2018/0215, a successful Supreme Court Appeal on the extraterritorial application of the SFO's powers to compel the production of documents under the Criminal Justice Act 1987
    • Conducting wide-ranging internal investigations for financial services institutions arising out of potential sanctions breaches, and for non-regulated entities following whistleblower allegations of internal fraud, committed by senior managers
    • Acting for multiple individual clients during compelled and 'caution' interviews during the SFO's long running investigations into allegations of bribery and corruption at a major UK-based engineering and energy company

    Gareth's key commercial litigation experience includes:

    • Representing a multinational financial services company, following a cyber breach leading to the company falling victim to a 'Change of Payee' fraud. The matter concluded with successful recovery of funds, including cryptocurrency, from fraudulent accounts and via a negotiated settlement with involved parties following long running litigation.
    • Advising a major company in the construction industry to investigate an incident of 'Authorised Push Payment' fraud including advising on strategy for recovery and information gathering from relevant financial institutions
    • Advising a UK-based financial services company to investigate an incident of fraud following a cyber breach, leading to the successful freezing of the entirety of the stolen funds, in excess of £1.5m transferred overseas
