    Richard specialises in handling catastrophic injury claims including spinal cord injuries and traumatic brain injuries arising out of Motor, Employers Liability and Public Liability claims. He is also a leading authority on Periodical Payments Orders (PPO) and discount rate cases both here and in outlying jurisdictions.

    He has over 25 years’ experience advising clients on personal injury claims and has advised clients on PPOs since shortly after the introduction of the current regime in 2005.

    Richard frequently advises insurers on a range of PPO issues including indexation, multiple compensators, security issues, statutory funding repayment provisions and other creative arrangements. He is responsible for agreeing the wording of PPOs for a number of insurers and has advised on a number of cases which involve creative settlements linked to the happening of specified events. He has also been involved in a number of ground breaking cases including the first PPO with a cap at the indemnity limit, the first PPO on the Isle Of Man, the first PPO which provides for the surplus funds on death to be paid to the insurer and the first capitalisation of a PPO. Richard has been responsible for some of the key decisions on the administrative terms of PPOs including Follett v Wallace and his team administers PPOs for a number of insurers.

    Relevant experience includes:

    • Handling a personal injury claim involving a Claimant who was injured at the age of 6 while travelling as a passenger in a car and suffered a severe head injury which left him with serious physical disability and severe cognitive impairment along with some behavioural problems. A collaborative approach was adopted throughout with regular meetings with his case manager and legal advisers. The claim was settled following adolescence for a lump sum of £15m.
    • Advising on a PPO involving a Claimant who suffered a high level spinal cord injury whose care was being funded by the NHS and also an insurer that had gone into liquidation requiring liaison with both parties’ legal advisers, the insurers’ administrators and the FSCS. Liability was apportioned between both parties and a PPO was drafted and agreed which provided for a shortfall reverse indemnity which ensures that the Claimant's care is fully funded, but requires her to account for the excess NHS funding.
    • Being jointly instructed by a leading Claimant firm and major insurer to advise on the protection of periodical payments payable under policies underwritten by foreign insurers following the UK‘s departure from the EU.
