  • Biography

    Eleanor specialises in insurance litigation, in particular defending and pursuing high value property damage claims arising from fires, floods, and construction-related disputes. A number of these claims have an international aspect.

    She also advises on policy coverage issues and associated disputes, with experience of claims relating to material damage, business interruption, construction, and public and products liability. Eleanor has also advised insurers on the drafting of a number of policy wordings.

    Eleanor's relevant experience includes:

    • Allianz Insurance plc v University of Exeter (2023) - advising Allianz in its successful defence of the University's Court of Appeal challenge relating to the application of a war exclusion clause following the detonation of a WWII bombs
    • International Entertainment Holdings v Allianz (2023) – successfully acting for Allianz in relation to business interruption coverage issues arising out of the COVID-19 pandemic
    • Acting for insurers and their insured in defending, and successfully settling, a multi-party, multi-million pound dispute in the TCC relating to the development and construction of a shopping centre
    • Acting on behalf of the successful defendants in the widely reported TCC case of Leeds Beckett University v Travelers Insurance Company (2017), a multi-million pound coverage dispute which considered the meaning of 'accidental damage'
    • Acting on behalf of the defendants in 199 Knightsbridge Development Ltd v WSP UK Ltd (2014), a multi-million pound claim
    • Acting for a major insurer on a policy coverage dispute at the Commercial Court, involving the interpretation of policy conditions relating to the scope of an insurers' liability to reinstate a property awaiting redevelopment
    • Successfully settling numerous claims, either as a result of mediations or joint settlement meetings
    • Providing training to clients on a range of insurance issues, including successful subrogations, implications of recent case law, the Insurance Act 2015, and damages for late payment
