The Regulation of Providers of Building Works and Miscellaneous Provisions Act 2022 (the “2022 Act”) was signed into law on 5 July 2022, and introduced the requirement for the establishment of a register called ‘the Construction Industry Register Ireland’, which will:
- regulate the providers of building works,
- provide for determination by the registration body of standards and competence
- required of providers of building works;
investigate and adjudicate upon any complaints against those providers; - establish an appeals committee to hear and determine appeals against certain
decisions of the registration body; - appoint the registration body to be the competent authority for the purposes of the
European Union (Recognition of Professional Qualifications) Regulations 2017
(S.I. No. 8 of 2017);
Not all sections of the Act have been commenced yet, however the majority of sections are now in force.
Commenting on the drivers behind the legislation, Minister Darragh O’Brien, Minister for Housing, Local Government and Heritage said that the legislation was to “promote a culture of competence, good practice and compliance with the Building Regulations in the construction sector.” He also noted that the establishment of an Independent Building Standards Regulator to “oversee building control nationwide and act as custodian of the Building Control Management System”, which is the current online platform used pursuant to the Building Control (Amendment) Regulations 2014 for the submission of commencement notices and other similar notices required to be lodged throughout the course of construction projects.
