Naomi specialises in defending claims against professionals.

She has over 17 years’ experience advising solicitors, accountants, tax and financial advisors, insolvency practitioners, surveyors and property agents. Her key clients include major professional indemnity insurers.

Naomi has dealt with a wide range of professional negligence disputes, including claims arising from failed tax avoidance schemes. Naomi regularly acts for solicitors in the defence of claims in the context of residential and commercial conveyancing, divorce, corporate/commercial transactions and lost litigation opportunities. Naomi also acts for accountants and tax advisors in defending claims relating to accounts preparation, audit, insolvency appointments and tax advice. Naomi has expertise in defending property agents against claims arising from the letting, management and sale of property, and defends valuation professionals. Naomi regularly advises on policy coverage and risk management. She is commercially minded and an advocate of ADR to explore creative solutions to complex disputes. 

Relevant experience includes:

• Defending a tax advisory practice, and an individual partner in a £35M multi party claim arising out of the collapse of a property sourcing club where allegations of negligence, shadow directorship, breach of fiduciary duty, unlawful diversion of income, dishonest assistance and fraudulent trading were made. Naomi project managed the case to a 5 week High Court trial, where the claim was successfully defended and indemnity costs awarded. Naomi was praised for her conscientious approach and attention to detail.
• Acting for a large regional solicitors’ firm in defending a £5M claim arising out of a business sale where it is alleged that inadequate advice was given on the warranties and indemnities in the share sale agreement, and on warranty and indemnity insurance.
• Defence of a £multi-million claim against an accountant following the collapse of precious metal refining business, where the liquidators allege our client assisted in transferring assets out of the failing business at an undervalue.
• Acting for numerous property agents and their insurers in the defence of claims from landlords and tenants, including arising out of problem tenancies, adverse incidents within rental properties, and misappropriations of client funds. Naomi’s in depth knowledge of the sector enables her to offer pragmatic commercial advice and devise cost effective solutions.
