The Facts

The final formality to bring statutory carer's leave into force has occurred and the Carer's Leave Regulations 2024 have now been made. As we reported in our January alert (see here) these regulations will provide employees with the right to take up to one week of statutory unpaid carer’s leave in a 12-month period to care for, or arrange care for, dependants with long-term care needs. The Regulations include provisions for protection from detriment and unfair dismissal relating to carer’s leave.

 

What this means for employers

Organisations who don't already offer any form of carer's leave will need to introduce a policy and those who already have a policy in place will wish to update it to ensure it affords at least the minimum statutory protection. It is also a good idea to introduce a system of record-keeping to track entitlement and leave taken.
