Biographie
Lynne specialises in professional negligence claims acting for professional insureds and their indemnity insurers. She is accredited by the Law Society of Scotland as a specialist in professional negligence. She is well known for handling professional negligence claims on behalf of solicitors and their insurers under the Law Society of Scotland Master Policy Scheme. Lynne has broad and lengthy experience also acting for a broad range of other professionals in complex, high-value professional negligence cases including accountants and auditors, surveyors, brokers, construction professionals, and education professionals and institutions, including independent schools, Universities and Colleges.
As well as dealing with claims, Lynne has regulatory experience, representing solicitor firms and individual solicitors in service and conduct complaints to the Scottish Legal Complaints Commission and to the Law Society of Scotland. She has also developed significant expertise in fraud cases, acting on behalf of insurers and their professional insureds in claims following incidences of payment instruction fraud perpetrated against the professional firm and/or its clients or suppliers.
Relevant experience includes:
- Acting for a firm of solicitors and insurers in relation to the defence of two separate but related actions in the Court of Session in which it is alleged the solicitors were in breach of contract and negligent in advising the claimants in relation to the entering into of two long leases in respect of care home premises, leading to substantial losses to the claimants.
- Acting for a firm of solicitors and insurers in a claim by former clients for recovery of a six figure sum paid away by them following an incidence of payment instruction fraud whereby the fraudsters gained access to the firm’s IT systems, intercepted email communication between the solicitor and client and defrauded the clients out of a six figure sum that they paid to the fraudsters thinking they were paying the funds (a large deposit for property) to the solicitor firm.
- Acting for a well-established firm of accountants and auditors and insurers in their defence of a £5m claim for negligence in relation to their preparation of a group company audit. This case was successfully resolved following a mediation.
- Acting for a leading Scottish University and insurers, in the defence of an action in the Court of Session, Edinburgh, for patent infringement. In the action the claimants seek damages and a publicity order. The subject matter of this case is of the utmost importance to the University, given the risk of creating an unwelcome precedent, and has required careful handling.
- Representing a firm of solicitors and insurers in their defence of a claim that they were negligent in advising the claimants in relation to their entering into a Loan and Option Agreement relating to development land. The claimants claim significant six figure losses as a result of the solicitors' alleged negligence.
- Advising a firm of M&E Engineers and insurers in the defence of a £5m multi- party action raised at the Court of Session relating to alleged design defects in the design and construction of a laboratory facility in Aberdeen. The claim related to alleged losses sustained by the Employer stemming from defects in the design and construction of the facility. The case ultimately settled at a multi-party mediation on favourable terms to the clients, avoiding a 6 week evidential hearing which had been due to start shortly after the mediation.
