Data Protection: More ICO draft guidance out for consultation

Overview

On 12 December 2023, the Information Commissioner’s Office (“ICO”) announced that it is producing an online resource relating to employment practices and data protection.

 

As part of this it provided draft guidance for consultation on keeping employment records (here) and recruitment and selection (here). The keeping employment records draft guidance aims to give guidance on lawfully processing workers' personal information, give workers guidance on their rights to access their employment records and addresses responsibility for records. The recruitment and selection guidance aims to provide guidance on compliance when carrying out recruitment exercises. The drafts also contain practical tools, such as checklists, to assist employers.

The consultations will close at 5pm on 5 March 2023.

 

What does this mean for employers?

It is useful that more guidance is coming out from the ICO. The ICO also announced that it would be releasing draft guidance on different topic areas to be included in the resource in stages, and adding to it over time. We have seen a lot of guidance from the ICO over the past few months including on information about workers' health and monitoring.
